GENERAL CONDITIONS OF ONLINE SALE
General provisionsThese conditions are valid exclusively between the company CASADEIGROUP SRL, with registered office at Via Carbonari 25, 47521 Cesena (FC) REA FO-335010, VAT number 04231660400, hereinafter referred to as "CASADEIGROUP" and any person making online purchases on the website www.casadeigioielli.it, hereinafter referred to as the "CUSTOMER". These conditions may be subject to change and the date of publication of the same on the site is equivalent to the date of entry into force.
These conditions govern purchases made on the website www.casadeigioielli.it, in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014 and Legislative Decree 70/2003 on e-commerce.
ARTICLE 1 - Object of the contract
With these general conditions of sale, CASADEIGROUP sells and the CUSTOMER purchases remotely the tangible personal property listed and offered for sale on the website www.casadeigioielli.it. The contract is concluded exclusively online, when the CUSTOMER accesses www.casadeigioielli.it and places a purchase order according to the procedure provided by the website itself.
The customer undertakes to read these general conditions of sale, in particular the pre-contractual information provided by CASADEIGROUP, before confirming their order, and to accept them by ticking the indicated box.
In the order confirmation email, the CUSTOMER will also receive a link to download and archive a copy of these general conditions of sale, as required by art. 51, paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
ARTICLE 2 - Pre-contractual information for the consumer - art. 49 of Legislative Decree 206/2005
Before concluding the purchase contract, the CUSTOMER examines the characteristics of the goods which are illustrated in the individual product sheets at the time of the CUSTOMER's choice.
Before the conclusion of the purchase contract and before the validation of the order with "payment obligation", the CUSTOMER is informed regarding:
- total price of the goods including taxes, with details of shipping costs and any other costs;
- payment method;
- the deadline by which CASADEIGROUP undertakes to deliver the goods;
- the conditions, terms and procedures for exercising the right of withdrawal (Article 6 of these conditions) as well as the standard withdrawal form referred to in Annex I, Part B of Legislative Decree 21/2014;
- information that the CUSTOMER will have to bear the cost of returning the goods in the event of withdrawal;
- existence of the legal guarantee of conformity for the purchased goods;
- after-sales assistance conditions and commercial guarantees provided by CASADEIGROUP.
The CUSTOMER may at any time, and in any case before the conclusion of the contract, obtain information relating to CASADEIGROUP, including its geographic address, telephone and fax number, and email address, information which is also reported below:

ARTICLE 3 - Conclusion and effectiveness of the contract
The sales contract is considered concluded when CASADEIGROUP sends the CUSTOMER an order confirmation email. The email contains the CUSTOMER's information and order number, the price of the purchased goods, shipping costs, the delivery address to which the goods will be sent, and a link to print and archive a copy of these terms and conditions.
The CUSTOMER undertakes to verify the accuracy of the personal data contained therein and to promptly communicate any corrections to CASADEIGROUP.
CASADEIGROUP strives to describe and present the items sold on the website as accurately as possible. However, some errors, inaccuracies, or small differences between the website and the actual product may occur. Furthermore, the photographs of the products presented on www.casadeigioielli.it do not constitute a contractual element, as they are merely representative.
CASADEIGROUP undertakes to deliver the goods within 30 days from the date CASADEIGROUP sends the order confirmation email to the CUSTOMER.
ARTICLE 4 - Product availability
Product availability refers to actual availability at the time the CUSTOMER places the order. However, this availability should be considered purely indicative because, due to the simultaneous presence of multiple users on the site, the products may be sold to other CUSTOMERS before the order is confirmed.
Even after CASADEIGROUP sends the order confirmation email, there may be cases of partial or total unavailability of the merchandise. In this case, the order will be automatically corrected by eliminating the unavailable product, and the CUSTOMER will be immediately notified by email.
If the CUSTOMER requests cancellation of the order, terminating the contract, CASADEIGROUP will refund the amount paid within 14 days from the day on which CASADEIGROUP became aware of the customer's decision to terminate the contract.
ARTICLE 5 - Payment methods
All payments by the CUSTOMER may only be made using the PayPal payment method, by bank transfer or cash on delivery.
If paying by PayPal, the actual charge will be made when CASADEIGROUP sends the order confirmation email.
Payments can also be made using Gift Cards and Loyalty Vouchers.
ARTICLE 6 - Prices
All product prices listed on the www.casadeigioielli.it website are in Euros and include VAT.
Shipping costs are not included in the purchase price, but are indicated and calculated at the end of the purchase process before payment is made.
The CUSTOMER accepts CASADEIGROUP's right to modify its prices at any time, however the goods will be invoiced based on the prices indicated on the site at the time the order is created and indicated in the confirmation email sent by CASADEIGROUP to the CUSTOMER.
In the event of a computer, manual, technical, or any other error that could result in a substantial change, unforeseen by CASADEIGROUP, in the retail price, making it exorbitant or clearly derisory, the purchase order will be considered invalid and canceled and the amount paid by the CUSTOMER will be refunded within 14 days of the cancellation date.
ARTICLE 7 - Right of withdrawal
In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within 30 days from the date of receipt of the products.
CUSTOMERS wishing to exercise their right of withdrawal must notify CASADEIGROUP by completing this form and sending it via email to casadeigioielli@gmail.com within 30 calendar days of receiving the goods. As required by the Consumer Code, the goods must be returned in perfect condition and with shipping costs paid by the buyer.
If the CUSTOMER exercises the right of withdrawal, he or she must return the goods within 30 days of notifying CASADEIGROUP of his or her intention to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005.
The goods must be returned to CASADEIGROUP SRL, Via Carbonari 25, 47521 Cesena (FC) or delivered to any CASADEIGROUP store in Italy.
The direct costs of returning the products are borne by the CUSTOMER.
The goods must be returned intact, in their original packaging, complete in all their parts (including packaging and any documentation and accessories: manuals, cables, etc.), and complete with the accompanying tax documentation. Without prejudice to the right to verify compliance with the above, CASADEIGROUP will refund the price of the returned products within a maximum of 14 days, including any shipping costs.
As provided for by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, CASADEIGROUP may withhold reimbursement until receipt of the goods or until the CUSTOMER has demonstrated that the goods have been returned to CASADEIGROUP.
CASADEIGROUP will process the refund using the same payment method chosen by the CUSTOMER during the purchase process. If payment was made by bank transfer, and if the CUSTOMER wishes to exercise their right of withdrawal, they must provide CASADEIGROUP with their bank details (IBAN, SWIFT, and BIC) by accessing the Contact Us section. These details are required for CASADEIGROUP to process the refund.
In the event of a return for a purchase made with a gift card or loyalty voucher, the amount will be refunded to the CUSTOMER in the form of a voucher identified by a promotional code that will be sent to the CUSTOMER's email address. Alternatively, in the event of a return made at a point of sale, the amount will be refunded in the form of a voucher delivered to the CUSTOMER.
The voucher will be valid for 2 years and can be used by the CUSTOMER for subsequent purchases in a single transaction.
ARTICLE 8 - Legal guarantee of conformity
In the event of receiving products that do not conform to the order or are defective, the CUSTOMER has the right to have the product restored to conformity free of charge by repair or replacement. The CUSTOMER may exercise this right if the defect becomes apparent within two years of delivery of the goods and reports the defect to CASADEIGROUP within two months of discovery.
ARTICLE 9 - Commercial guarantee
All products presented on the website www.casadeigioielli.it benefit, in addition to the legal guarantee of conformity referred to in the previous article, from a commercial guarantee whose duration is indicated on the product information sheets.
ARTICLE 10 - Delivery methods
CASADEIGROUP will only accept orders for delivery within Italy and the Republic of San Marino. Products will be delivered via express courier to the address indicated by the CUSTOMER when placing the order, no later than 30 days after the CUSTOMER receives the order confirmation email from CASADEIGROUP.
For each order placed on the website www.casadeigioielli.it, CASADEIGROUP issues an invoice for the shipped goods. The invoice is available and printable, after the order has been processed, in the "My Orders" section of the CUSTOMER's "My CASADEIGROUP Account" area. The invoice will contain the information provided by the CUSTOMER during the purchase process. Once the invoice has been issued, it will not be possible to make any changes to the information provided.
ARTICLE 11 - Responsibility
CASADEIGROUP assumes no responsibility for disruptions attributable to force majeure or unforeseeable circumstances, including those resulting from internet malfunctions or disruptions, in the event that it is unable to fulfill the order within the timeframes stipulated in the contract.
ARTICLE 12 - Access to the site
The CUSTOMER has the right to access the site for browsing and making purchases. Any other use, particularly commercial, of the site or its content is not permitted. All elements of this site, whether audio or visual, and the related technology used remain the property of CASADEIGROUP and are protected by intellectual property rights.
ARTICLE 13 - Cookies
The website www.casadeigioielli.it uses "cookies." Cookies are electronic files that record information about the CUSTOMER's browsing experience on the site (pages viewed, date and time of visit, etc.) and allow CASADEIGROUP to offer a personalized service to its customers.
CASADEIGROUP informs the Customer of the possibility of disabling the creation of such files by accessing their Internet settings menu. It is understood that this will prevent the Customer from proceeding with the online purchase.
ARTICLE 14 - Integrality
These General Conditions of Sale constitute the entirety of the clauses that comprise them. If one or more provisions of these General Conditions of Sale are held to be invalid or declared as such pursuant to law, regulation, or following a decision by a court of competent jurisdiction, the other provisions will remain in full force and effect.
ARTICLE 15 - Applicable law and competent court
These General Conditions of Sale are subject to Italian law.
Any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the Court of the place of residence or domicile of the CUSTOMER, if located within the territory of the State.
In any case, it is possible to optionally resort to the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale by accessing the following site: https://webgate.ec.europa.eu/odr .
